An Ohio woman was recently awarded $1.2 million in a medical malpractice suit after a slow diagnosis left her unable to draw deep breaths.

Victoria Stamper visited Dr. Michael Draznik in 2009, complaining of abdominal pains. Dr. Draznik’s ordered Stamper to surgery; a partial hysterectomy. When this failed to alleviate Stamper’s pain, Dr. Draznik ordered a second surgery.
When this second surgery failed to treat Stamper’s abdominal pain, Dr. Draznik finally sent her for a CT scan. The scan revealed that the cause of Stamper’s distress was a perforated bowel. Further testing revealed the two previous and unnecessary surgeries caused Stamper to lose 20 percent of her lung capacity.
“Because it took so long to do the appropriate test, she already had (acute respiratory distress syndrome) and now walks with a walker because of the difficulty she has breathing,” said Marc Pera, Stamper’s lawyer.
The courts awarded Stamper over $1.2 million for losses and damages, but only after a lengthy and costly trial. This suit was not Dr. Draznik’s first medical malpractice case. In fact, court records indicate this was not even Dr. Draznik’s first malpractice suit involving failure to order a CT scan in a timely fashion.
But while Stamper’s experience with Dr. Draznik was not unique, the positive outcome of her trial is. The greater majority the previous malpractice suits against Dr. Draznik were dismissed before they went to trial, as the plaintiffs settled out of court for undisclosed settlement amounts. In fact, of all the previous patients to file suit against Dr. Draznik, Stamper is the first to obtain a judgment.
The reason so many plaintiffs fail to realize a full judgment is simple; court proceedings are expensive and time consuming endeavors which can take years to play out in court. During the course of a trial, legal fees, medical bills, and other expenses pile up, which puts mounting pressure on plaintiffs to settle out of court for far less than they deserve.
Ohio Lawsuit Settlement Funding Could Help Med Mal Lawsuit Plaintiffs
For many of these plaintiffs, acquiring settlement funding can go a long way toward alleviating the pressure to settle quickly. Lawsuit settlement funding is a type of non-recourse transaction available to plaintiffs in a variety of civil suit proceedings, including medical malpractice suits. Lawsuit settlement funding provides a cash advance in anticipation of a settlement or judgment. The cash can be used to pay medical bills, legal fees, utilities, rent, or any other expenses. And should the plaintiff fail to win their case, these funds do not have to be repaid.
Unlike traditional loans, lawsuit settlement funding is awarded based on the strength of your case, not your credit or employment history. The funds made available can be accessed in as little as 24 hours and there are no upfront fees associated with securing lawsuit settlement funding.
You don’t pay until you win your case. And if you don’t win, you don’t pay. It’s that simple.
If you or someone you know is going through the long and costly process of fighting for fair compensation in a medical malpractice suit in Ohio or another state, consider lawsuit settlement funding. It can give you the financial flexibility to keep up your fight without feeling the pressure to settle for less than you deserve.
