NASCAR three time champion Tony Stewart is still waiting to hear if he will be charged with the death of 20-year-old Kevin Ward Jr. who lost his life at Canandaigua Motorsports Park on August 9th. Ward got out of his racing car ready to confront Stewart while under caution. He was subsequently hit by Stewart resulting in his demise.

The Sheriff of Ontario County, Philip Povero, reported his office had finished their investigation and have presented their report to the district attorney’s office for a final decision.
The question is whether Stewart recklessly acted in a manner that resulted in the death of Ward. Stewart could face a charge of 2nd degree manslaughter if the prosecution thinks they can prove Stewart behaved recklessly. However, the district attorney could also decide there is insufficient evidence to support any charges and decide not to present the case for indictment in front of a grand jury.
Whether Stewart’s actions were reckless or simply negligent, Ward’s family may decide to file a wrongful death lawsuit against Stewart.
Kevin was a young man when he lost his life unexpectedly which is a great blow to his family. He was also a promising racing driver who could have added significantly to his family financially.
